PowerWebNet agrees to provide the paying customer with services according to the Terms Of Service listed below. Violators of the PowerWebNet TOS are not eligible for a refund. |

Usage of PowerWebNet's services constitutes acceptance and agreement to PowerWebNet's Terms Of Service. |

All of the terms within PowerWebNet's Terms Of Service are subject to change and all hosting plans are subject to the Terms Of Service. |

Webpages or websites related to any form of illegal activities are strictly prohibited. If webpages or websites related to illegal activities are placed on the customers allocated PowerWebNet webspace, their account may be terminated without notice. If a request is made by law enforcement officers for any of the customer's information (IP address, Phone #, etc.) PowerWebNet reserves the right to submit this information to the authorities. |

PowerWebNet reserves the right to spotlight any customer's website or webpage on the PowerWebNet website. |

All monthly plans must be paid for within 10 days of payment request. After these 10 days, services will be suspended. And, after 5 more days of non-payment, PowerWebNet will remove all information associated with the user's account. PowerWebNet reserves the right to deny the customer access to our services until payment is received. |

Any bill disputes or overcharges must be reported to PowerWebNet within 10 days of arrival of the invoice. If bill disputes or overcharges are not reported within 10 days of arrival of the invoice, PowerWebNet reserves the right to disregard the dispute or overcharge. |

If a refund is requested, it will first be reviewed by PowerWebNet, upon reviewing and acception, PowerWebNet will refund the stated amount within 5-10 business days. |

Entry into our DNS servers may take 3-5 days to complete. Unforeseen complications may cause for longer waiting times. |

Customer support is provided free-of-charge to customers of PowerWebNet; however, customer support may be denied to any customer who violates the PowerWebNet Terms Of Service. |

Customer support covers just about everything provided by PowerWebNet; however, it is at PowerWebNet's discretion whether or not to provide support on webpage creation, scripting languages, etc. |

PowerWebNet is not responsible for backing up any customer's data. All customers should conduct their own data backups. |

The service provided by PowerWebNet may be canceled by the customer at any time without cause. PowerWebNet reserves the right to cancel any customer's account without notice if the customer violates any of the PowerWebNet Terms Of Service. |

If any customer of PowerWebNet changes the DNS settings of their domain from the PowerWebNet servers, PowerWebNet will consider the hosting account canceled, and terminate future payments, and the account. |

Sites that provide pornographic and/or sexually related material and/or links to sites that provide such content, are subject to termination without notice or warning. |

If PowerWebNet receives any notice of unsolicited electronic e-mail (spam) coming from any customer's domain, that customer's services can and will be terminated without notice. |

If PowerWebNet receives any notice of mass electronic e-mail (mail bombings) coming from any customer's domain, that customer's services can and will be terminated without notice. |

Any sites provided and/or used for IRC-related purposes (this includes bot scripts, etc.) can and will have their services terminated by PowerWebNet. |

Any sites that utilize an abnormal amount of system resources, may be permanently or temporarily shut down while PowerWebNet diagnoses the problem. |

Any sites that cause a server's security to be breached, may be permanently or temporarily shut down while PowerWebNet diagnoses the problem. |

The liability of PowerWebNet on any customer's account is limited to the amount of money that the customer has paid PowerWebNet. |

If any customer incurs legal expenses upon PowerWebNet, we reserve the right to recover these expenses from the customer. |

If any customer's activity causes legal action to be taken (i.e, suing, etc.) against PowerWebNet, the customer will pay any damages awarded against PowerWebNet, as well as all other legal fees (i.e, lawyers, etc.). |

SSH access is given to the customer with the following in consideration: 1) It will be used solely for administering your website; 2) It will not be used to run an IRC server, an Eggbot, a Shoutcast or internet radio station, or any daemon-like software, etc; and 3) Will not be used as a medium for connecting to any other services (i.e., using SSH to SSH into another server). In short: No background processes will be allowed. |
